Estate Planning Isn’t One-Size-Fits-All
When planning for the future, many people wonder: Do I need a Will, a Trust, or both? The answer depends on your goals, your family situation, and your assets.
At Dickey Law Group, we guide families in The Woodlands and across Texas through the decision-making process so they choose the right tools to protect their loved ones.
What is a Will?
A Will is a legal document that states:
Who will receive your assets.
Who will manage your estate (the executor).
Who will care for minor children (guardianship).
Wills go through probate, which is the court process for settling your estate. While probate in Texas is often more efficient than in other states, it still involves court oversight.
Since a Will must go through probate, it’s important to understand how that process works in Texas. Learn more here
What is a Trust?
A Trust is a legal arrangement where a trustee manages assets for the benefit of your chosen beneficiaries.
The most common type is a revocable living trust, which you can create and manage during your lifetime. Assets placed in the trust bypass probate when you pass away, often saving time and preserving privacy.
When a Will Makes Sense
A Will is often the right choice if you:
Have a straightforward estate.
Need to name guardians for minor children.
Want a simple, cost-effective plan.
And if you don’t have a Will at all, the state has a plan for you—but you might not like it. Find out what happens without a Will in Texas here
When a Trust Makes Sense
A Trust may be better if you:
Own real estate in multiple states.
Want to avoid probate.
Value privacy in handling your affairs.
Have complex family dynamics or blended families.
Want more control over how and when assets are distributed.
Should You Have Both?
Many Texans benefit from having both. A Trust can handle the transfer of major assets, while a Will acts as a safety net (“pour-over Will”) for anything not placed in the Trust.
Choose the Tool That Fits Your Family
Every family is different. The best estate plan is the one that reflects your goals, protects your loved ones, and minimizes stress when the time comes.
At Dickey Law Group, we’ll help you understand whether a Will, a Trust, or a combination of both is right for you.
